Do You Need an Apostille for a Power of Attorney?

Welcome to Maryland Prime Notary & Apostille Notary Services

If your Power of Attorney (POA) will be used in another country, it will typically require an apostille or authentication to be legally recognized. Common situations include:

  • Buying or selling property abroad
  • Managing financial matters overseas
  • Immigration or residency applications
  • Handling legal or family matters internationally

If the destination country is part of the Hague Convention, an apostille is required. If not, the document must receive additional steps of authentication and embassy legalization.

IMPORTANT REQUIREMENTS FOR POWER OF ATTORNEY DOCUMENTS

Before a Power of Attorney can be apostilled, it must meet specific requirements:

  • The document must be properly notarized
  • It may require witness signatures
  • The notary’s signature must be valid and verifiable
  • The document must meet state-specific formatting requirements

In Maryland and other states, a POA must be notarized before it can be authenticated or apostilled.

Common Mistakes That Cause Delays or Rejection

Power of Attorney documents are one of the most commonly rejected document types due to errors.

We frequently see:

  • Incorrect or incomplete notarization
  • Missing witness signatures
  • Documents prepared incorrectly for the destination country
  • Attempting to apostille a copy instead of the original notarized document
  • Using a notary from a different state than required

These issues can result in delays, rejection, or the need to restart the process entirely.

"Just What We Needed to Move Our Paperwork Forward"

Super professional. We needed papers apostilled and were completely new to the process. Both my wife and I work during business hours and didn’t have the means to run all over getting gold seals and rubber stamps, so the service provided by Maryland Prime Notary & Apostille Service was just what we needed to move our paperwork forward.  ⭐️⭐️⭐️⭐️⭐️
